In New Jersey the denial rate at application for the year 2006 was 46.6%. The denial rate at reconsideration was 79.8%. Source FY 2006 DIODS EXTRACT.

Recently released, is the allowance rates at application reconsideration for New Jersey. For the fiscal year 2008 45% of the cases won at application and 20.8% won at reconsideration. This is according to the state agency operations report prepared December 12, 2008. Update win and denial percentages: I do not have the application and reconsideration winning percentage for NJ for 2011 but the National Average for the year 2010 was 35% approval at application and 13% approval rate at reconsideration. At the hearing level for 2010 the National Average of cases that won was 62%.

Update for year 2012: The average processing time for the Newark, NJ ODAR (hearing stage) is 394 days. The Vorhees, NJ ODAR office, also called South Jersey office, average processing time is 344 days. In Jersey city it is 312 days. This is from National Ranking Report statistics for the year 2012.

Update for year 2011: The average time it took from the time you request a hearing until you got a decision as of 2/25/2011 was 415 days for the Newark Hearing Office and Pennsauken (formerly Voorhees) Hearing Office was 324 days.

If you are getting your medical records for your SSDI claim in NJ then you will want to know that your doctors are limited in what they can charge you for medical records.

Copies provided by doctors: Cap of $1.00 per page or $100 for the entire record, whichever is less, with a minimum charge of $10.00 permissible. If the record is less than 10 pages, the doctor may charge up to $10.00. If a summary is provided in lieu of the actual records, the cost cannot exceed the cost that would be charged for the actual record. N.J. Administrative Code, Title 13, Chapter 35. 13:35-6.5(c) 4.
Copies provided by hospitals to a patient or the patient’s legally authorized representative: Cap of $1.00 per page or $100.00 for up to 100 pages. 25¢ for each page thereafter, up to a maximum of $200 for the entire record. Additional charges of $10.00 for a search fee and postage. N.J. Administrative Code, Title 8, § 43G-15.3(d).
